Chameleon and double-brokering red flags
Double brokering means a carrier (or someone posing as one) re-brokers a load without authority or permission. Chameleon operations shed a bad record by reappearing under a new name or number. Both leave the hauling carrier unpaid.
Red flags
- Rate confirmation from a company whose name, MC or contact details don't match FMCSA SAFER.
- A "broker" whose FMCSA record shows only carrier authority.
- Brand-new authority combined with high-paying, urgent loads.
- Pickup paperwork (BOL) lists a different broker or carrier than your rate con.
- Pressure to skip check calls with the shipper, or instructions not to contact the shipper.
- Payment instructions or factoring changes sent by email at the last minute.
- Same address, phone or officers as a recently revoked broker.
What the law says
Providing brokerage services without broker authority is unlawful under 49 U.S.C. 14916. Violators face civil penalties up to $10,000 per violation and are liable to injured parties.
Protect yourself
- Verify the broker on FMCSA before accepting, and call the number on the FMCSA record, not the one in the email.
- Make sure the BOL shipper and broker match your rate con.
- Report confirmed double brokering on RatedPaid with documentation.
